# Sucesiones y Donaciones

Establecido bajo la [Ley 29/1987](https://www.boe.es/buscar/act.php?id=BOE-A-1987-28141), de 18 de diciembre, es un impuesto directo, personal, subjetivo y progresivo que grava los incrementos patrimoniales obtenidos a título lucrativo (sin contraprestación económica).

Si hablamos de regalos que se reciban en forma de criptomonedas, entonces estaremos hablando de una donación por la cual el receptor (donatario) deberá tributar en el Impuesto sobre Donaciones en España, como regla general. Ahora bien, esta regla deberá matizarse en función de la residencia del donatario y la localización de los activos que se donen. 

Por su parte, la donación de un activo podría generar en el donante una ganancia patrimonial. Esta ganancia se determinará según las reglas generales de las ganancias patrimoniales, utilizando como valor de transmisión el valor de mercado de las criptomonedas regaladas/donadas.
